I have been asked to review another similar case of a premature baby with severe NEC who was fed formula, without any discussion by the doctor before hand about risks of NEC. The attorney is going after the formula company, not the doctors, for failure to warn of the risks of NEC for preterm babies fed formula, especially if pasteurized donor human milk is available as an alternative. Please note that in 2012 the AAP guidelines for feeding preemies recommended that if mother’s milk was not available, then donor human milk should be used.
Mead Johnson expressly denies that the medical and scientific community has confirmed any link between NEC and any infant nutritional products containing cow’s milk…..WOW!!

How can they say that when formula fed babies are 5 times more likely to get NEC?
